These Terms of Service ("Terms") govern your use of AirScanner (the "Service"), operated by Talya Global Lojistik Hizmetleri ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract. Accounts must be registered with accurate information and used by the person or organisation named at registration.
2. Accounts and security
You are responsible for safeguarding your password and for all activity under your account. Notify us at info@talyasmart.com immediately if you suspect unauthorised access.
3. What the Service is — and is not
AirScanner aggregates air freight rates, cargo capacity, airline metadata and air waybill status from airlines, air-cargo marketplaces and data providers. We are not an airline, a customs broker, or the carrier of your cargo. Where a booking is placed through the Service, the contract of carriage is between you (or your consignor) and the operating carrier, and is governed by that carrier's conditions of carriage and by the applicable international convention (Montreal or Warsaw, as applicable).
Data is provided on a best-effort basis and may be incomplete or out of date. You agree to verify time-critical information — flight departure and arrival, cargo acceptance cut-off, customs status, special-handling acceptance — directly with the carrier or handling agent before acting on it.
4. Chargeable weight, rates and quotes
Rates shown include our margin over the underlying buy rate, and are quoted against chargeable weight — the greater of gross weight and volumetric weight at the IATA 1:6000 ratio. Fuel and security surcharges are itemised separately. A quote is an offer to book at the stated price for the stated validity window only; it can change or lapse when the underlying carrier rate, capacity or surcharge changes. Final charges are determined by the weight and dimensions measured at acceptance, not by the figures you entered.
5. Your cargo obligations
You are responsible for ensuring that every shipment you tender is lawful and correctly declared. You agree not to book, or attempt to book, cargo that:
- is prohibited or restricted for air carriage and not declared as such — including dangerous goods under the IATA Dangerous Goods Regulations, lithium batteries, magnetised material, live animals or human remains;
- is misdeclared as to commodity, weight, dimensions, packing or value;
- breaches applicable export-control, sanctions, dual-use, CITES or narcotics regulations;
- is not accompanied by the security status, known-consignor declaration or documentation the origin state requires.
Misdeclared cargo is a safety matter, not a paperwork one. We may refuse, cancel or report a booking where we have reasonable grounds to believe a declaration is false, and you remain liable for any charge, fine or penalty a carrier or authority imposes as a result.
6. Acceptable use of the platform
You agree not to:
- reverse-engineer, scrape or systematically download Service data beyond your subscription quota;
- resell, sublicense or re-publish Service data without a written commercial agreement;
- probe, scan or test the vulnerability of the Service without written authorisation;
- use the Service in a way that overloads our infrastructure or degrades it for other users.
7. Subscription, fees and renewal
There is no free tier. All plans are paid and start at $1.99/month (Starter). Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled from your billing page. Quotas reset on the first day of each calendar month at 00:00 UTC. One air shipment means one booking request that results in one master air waybill; cancelled, rejected and expired bookings do not consume quota.
Cancellation stops future renewals — your access continues to the end of the period you have already paid for, after which the account moves to No plan. We do not provide pro-rated refunds for partial months except where required by law. Prices may change; we will give at least 14 days' notice by email and in-app banner for any increase affecting your subscription.
We may rate-limit, suspend or withdraw access without notice if we detect abuse, automation, sustained over-quota use or fraudulent payment activity.
8. Intellectual property
AirScanner, the AirScanner mark, the platform UI, brand assets, code, documentation and the curated databases we maintain (airline registry, airport reference, product taxonomy) are our intellectual property or that of our licensors. Airline names, marks and IATA designators shown on the Service remain the property of the respective carriers and are used for informational reference only. See the End User Licence for what you may do with the data.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability. We do not guarantee that the Service will be error-free, that defects will be corrected, or that carrier-supplied rate, capacity and status data will be complete or current.
10. Limitation of liability
To the maximum extent permitted by applicable law our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profit, cargo, revenue, goodwill or data. Claims for loss of or damage to cargo lie against the operating carrier under the applicable convention, not against us.
11. Termination
You may cancel your account at any time from the billing page or by emailing us. We may suspend or terminate your account if you breach these Terms, if payment fails after reasonable notice, or if continuing to serve you would expose us to legal risk. On termination you lose access to paid features; we keep your account record for the period required by law and then delete it.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or a prominent in-app banner at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law and venue
These Terms are governed by the laws of the Republic of Türkiye. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts and execution offices of Istanbul (Çağlayan), Türkiye.
